TERMS OF SERVICE

OVERVIEW

This website is operated by 827 Outpost (“827 Outpost,” “we,” “us,” or “our”). Throughout the website, the terms “we,” “us,” and “our” refer to 827 Outpost. 827 Outpost offers this website, including all information, tools, products, and services available through the website (collectively, the “Service”), conditioned upon your acceptance of these Terms of Service.

By visiting our website, creating an account, placing an order, purchasing a product, or otherwise using the Service, you agree to be bound by these Terms of Service (“Terms”), together with any additional policies referenced herein or made available through the website, including our Privacy Policy, Shipping Policy, and Return Policy.

Please read these Terms carefully before using our website. If you do not agree to these Terms, you should not access the website, place an order, or use the Service.

We reserve the right to update or modify these Terms from time to time by posting an updated version on this website. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms to the extent permitted by applicable law.

Our online store is hosted by Shopify Inc., which provides the e-commerce platform that enables us to sell our products and services.

SECTION 1 — ONLINE STORE TERMS

By using the Service, you represent that you are at least the age of majority in your state or jurisdiction of residence or that you have the consent of a parent or legal guardian where required by law.

You may not use our products, website, or Service for any unlawful, fraudulent, abusive, or unauthorized purpose.

You may not introduce viruses, malware, malicious code, automated scraping tools, or other technologies intended to interfere with the operation or security of the website or Service.

A violation of these Terms may result in suspension or termination of your access to the Service and cancellation of pending orders where permitted by law.

SECTION 2 — PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to display and describe our products accurately. However, colors, textures, finishes, dimensions, and other product characteristics may appear differently depending on your device, monitor, photography, manufacturing variations, materials, or other factors.

Products made from leather, hides, natural fibers, wood, or other natural materials may contain variations in color, grain, texture, markings, or appearance. Such natural variations are not necessarily defects.

Product descriptions, photographs, specifications, availability, and prices may be changed at any time without notice.

We reserve the right to discontinue any product or limit the quantities available for purchase.

SECTION 3 — PRICING AND ERRORS

We make reasonable efforts to ensure that prices, product descriptions, promotions, discounts, shipping charges, and other information are accurate.

Occasionally, our website may contain typographical errors, incorrect prices, inaccurate descriptions, incorrect promotional information, inventory errors, or other inaccuracies.

To the extent permitted by applicable law, we reserve the right to correct errors, update information, cancel an order, or refuse to fulfill an order affected by a material pricing, inventory, promotional, or other error, including after an order has been submitted.

If we cancel an order after payment has been processed, we will issue an appropriate refund for the cancelled portion of the order.

SECTION 4 — ORDERS AND ACCEPTANCE

Submitting an order does not necessarily constitute our acceptance of the order.

We reserve the right, subject to applicable law, to accept, reject, limit, hold, or cancel an order for reasons including suspected fraud, payment authorization problems, inventory shortages, pricing errors, shipping restrictions, unusually large quantities, suspected resale activity, or other circumstances affecting our ability to fulfill the order.

We may request additional information to verify an order, including confirmation of billing, shipping, identity, or payment information.

We may limit or prohibit orders that, in our reasonable judgment, appear to be placed by unauthorized dealers, resellers, distributors, or other commercial purchasers.

If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method, subject to applicable law and payment processor procedures.

SECTION 5 — BILLING AND ACCOUNT INFORMATION

You agree to provide current, complete, and accurate billing, shipping, contact, and account information for all purchases.

You are responsible for ensuring that the email address, telephone number, billing address, shipping address, payment information, and other information submitted with your order are accurate.

You agree to promptly update your information when necessary so that we can complete transactions and contact you regarding your orders.

SECTION 6 — SHIPPING AND DELIVERY

Shipping and delivery estimates are estimates only unless we expressly state otherwise.

Delivery dates may be affected by carrier delays, weather, natural disasters, labor disruptions, customs procedures, transportation interruptions, high-volume periods, incorrect addresses, or circumstances outside our reasonable control.

We are not responsible for delays caused by shipping carriers or circumstances outside our reasonable control, except where applicable law provides otherwise.

Shipping Address

Customers are responsible for providing a complete and accurate shipping address when placing an order.

If you discover an error in your shipping address, contact us as soon as possible. We will make reasonable efforts to correct the address before shipment, but we cannot guarantee that an address can be changed once an order has entered fulfillment or has been transferred to a shipping carrier.

If an order is returned to us because of an incorrect or incomplete address provided by the customer, failed delivery attempts, refusal of delivery, or failure to retrieve the package from the carrier, additional shipping charges may apply before the order is reshipped.

Any refund associated with a returned or undeliverable package will be handled in accordance with our Return Policy and applicable law.

SECTION 7 — DELIVERY CONFIRMATION AND LOST OR STOLEN PACKAGES

When a shipping carrier's tracking information indicates that a package has been delivered to the shipping address provided with the order, we may rely on that delivery confirmation when investigating a claim.

If you believe a package has been lost, stolen, misdelivered, or damaged in transit, please contact us promptly so that we can assist with an investigation or carrier claim when appropriate.

Carrier tracking showing delivery does not waive any rights you may have under applicable law.

We reserve the right to request additional information or documentation reasonably necessary to investigate a lost-package, non-delivery, fraud, or payment dispute claim.

SECTION 8 — RETURNS, EXCHANGES, AND REFUNDS

Returns, exchanges, and refunds are governed by our Return Policy, which is incorporated into these Terms by reference.

Customers are responsible for reviewing the Return Policy before making a purchase.

Products must satisfy the eligibility requirements and applicable deadlines stated in the Return Policy.

Unless otherwise required by law or expressly stated in our Return Policy, returned merchandise must be in the required condition and include any packaging, tags, accessories, or other items specified in the Return Policy.

Initiating a return request or contacting us about a possible return does not, by itself, extend a return deadline unless we expressly agree otherwise in writing.

Items returned outside the applicable return period or otherwise failing to satisfy the Return Policy may be refused or returned to the customer to the extent permitted by applicable law.

Refunds for eligible returns will generally be issued to the original form of payment, subject to the Return Policy and applicable law.

SECTION 9 — REFUSED AND UNCLAIMED PACKAGES

Refusing delivery does not automatically constitute an approved return.

Packages that are refused, unclaimed, returned to sender, or otherwise returned without following our applicable return procedures will be evaluated under our Return Policy.

To the extent permitted by law, actual shipping or other non-refundable costs associated with an unauthorized, refused, or unclaimed shipment may be deducted from an otherwise applicable refund if permitted under our posted Return Policy.

SECTION 10 — PAYMENT DISPUTES AND CHARGEBACKS

If you believe there is a problem with an order, charge, return, refund, or delivery, we encourage you to contact us at info@827outpost.com so that we have an opportunity to investigate and resolve the issue.

Nothing in these Terms prevents you from exercising any lawful rights available through your credit card issuer, bank, payment provider, or applicable consumer-protection law.

If a payment dispute or chargeback is initiated, we may provide the payment processor, financial institution, card network, or other parties involved in the dispute with information reasonably relevant to the transaction and dispute, including order records, communications, shipping and tracking information, delivery confirmation, return records, refund records, and evidence concerning your acceptance of our policies, subject to applicable privacy laws and our Privacy Policy.

We reserve the right to suspend or restrict future purchases associated with accounts or transactions involving suspected fraud, abuse, or repeated misuse of payment dispute procedures, to the extent permitted by applicable law.

SECTION 11 — FRAUD AND UNAUTHORIZED ACTIVITY

We reserve the right to review orders for potential fraud or unauthorized activity.

We may delay fulfillment while conducting reasonable verification procedures.

Where permitted by law, we may refuse or cancel transactions that we reasonably believe are fraudulent, unauthorized, abusive, or otherwise pose a security or financial risk.

Fraudulent activity may be reported to payment processors, financial institutions, shipping carriers, law enforcement, or other appropriate parties when permitted or required by law.

SECTION 12 — PROMOTIONS, COUPONS, AND DISCOUNTS

Promotional offers, discount codes, coupons, gifts, and other incentives may be subject to additional terms and expiration dates.

Unless expressly stated otherwise, promotional offers may not be combined.

We reserve the right to modify, suspend, cancel, or refuse a promotion where we reasonably determine that it has been used fraudulently, improperly, contrary to its stated terms, or as the result of a technical or pricing error, subject to applicable law.

SECTION 13 — SMS/RCS MESSAGING PROGRAM

Consent to Receive Messages

By voluntarily opting in to the 827 Outpost messaging program, you consent to receive recurring SMS, MMS, and/or RCS messages from or on behalf of 827 Outpost at the mobile telephone number you provide.

Where applicable, messages may be sent using automated technology or an automated telephone dialing or messaging system.

Consent Is Not a Condition of Purchase

Consent to receive marketing messages is not a condition of purchasing any goods or services from 827 Outpost.

You may shop with 827 Outpost without subscribing to marketing messages.

Message Frequency

Message frequency varies.

The number and frequency of messages you receive may depend on your interactions with 827 Outpost, your orders, promotions, and the messaging programs for which you have enrolled.

Message and Data Rates

Message and data rates may apply.

Your wireless carrier's standard messaging, data, and other rates and charges may apply to messages sent or received as part of the program. You are responsible for any charges imposed by your wireless carrier.

Opting Out

You may opt out of marketing messages at any time by replying STOP to a message from 827 Outpost.

We will process opt-out requests in accordance with applicable law. We may send a final confirmation message acknowledging your opt-out.

We will also honor other legally recognized methods of revoking consent where required by applicable law.

After opting out, you may still receive non-marketing communications that are necessary or appropriate to complete transactions you request, provide customer service you request, or otherwise communicate with you where permitted by law.

If you change, deactivate, surrender, or transfer your mobile number, you should opt out of the messaging program before doing so or notify us promptly so that messages intended for you are not sent to another person.

We may modify or discontinue all or part of our messaging program at any time, subject to applicable law.

SECTION 14 — THIRD-PARTY SERVICES AND LINKS

The Service may contain links to websites, applications, payment services, social-media platforms, shipping providers, or other services operated by third parties.

To the extent permitted by law, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and adapt content that you intentionally submit for publication or promotional use, subject to our Privacy Policy and applicable law.

You may not submit content that is unlawful, fraudulent, defamatory, threatening, obscene, malicious, infringing, or otherwise violates the rights of another person.

We reserve the right, but not the obligation, to remove content that violates these Terms.

SECTION 16 — INTELLECTUAL PROPERTY

Unless otherwise indicated, the website and its contents—including text, graphics, logos, photographs, product images, designs, videos, software, trademarks, and other materials—are owned by or licensed to 827 Outpost and are protected by applicable intellectual-property laws.

You may use the website for your personal, non-commercial use.

You may not reproduce, distribute, modify, sell, exploit, scrape, republish, or commercially use our website or its contents without our prior written permission, except as permitted by applicable law.

  10. To impersonate another person or misrepresent your identity.

We may restrict or terminate access to the Service for prohibited activity, subject to applicable law.

SECTION 18 — PERSONAL INFORMATION

Our collection, use, disclosure, and protection of personal information is governed by our Privacy Policy.

Please review the Privacy Policy for additional information about our privacy practices and any rights available to you under applicable law.

SECTION 19 — DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND SERVICE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

WE DO NOT WARRANT THAT THE WEBSITE OR SERVICE WILL ALWAYS BE UNINTERRUPTED, SECURE, TIMELY, OR ERROR-FREE.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY WARRANTY, GUARANTEE, OR OTHER RIGHT THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

SECTION 20 — LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 827 OUTPOST AND ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE OR PURCHASE OF PRODUCTS.

THIS INCLUDES, TO THE EXTENT PERMITTED BY LAW, LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES.

THE LIMITATIONS IN THIS SECTION DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

Some jurisdictions do not allow certain limitations or exclusions of liability. In those jurisdictions, these limitations apply only to the maximum extent permitted by law.

SECTION 21 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless 827 Outpost and its affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful use of the Service, your material violation of these Terms, or your violation of the rights of another person.

SECTION 22 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law and, if necessary, severed from these Terms.

The remaining provisions will remain in full force and effect.

SECTION 23 — NO WAIVER

Our failure to exercise or enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

SECTION 24 — ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Return Policy, Shipping Policy, and any other policies or terms expressly incorporated by reference, constitute the agreement between you and 827 Outpost concerning your use of the Service.

SECTION 25 — GOVERNING LAW

These Terms and any dispute arising from or relating to these Terms, the website, the Service, or a transaction with 827 Outpost will be governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent federal law applies or applicable law requires otherwise.

Subject to any rights that cannot lawfully be waived, any judicial proceeding relating to these Terms or the Service shall be brought in a court of competent jurisdiction in Los Angeles County, California.

Nothing in this section limits any consumer right or remedy that cannot lawfully be waived.

SECTION 26 — CHANGES TO THESE TERMS

We may update these Terms from time to time.

When we make changes, we may update the “Last Updated” date at the top of this page and post the revised Terms on our website.

Changes will become effective as provided by applicable law.

Your continued use of the Service after the effective date of revised Terms constitutes acceptance of those Terms to the extent permitted by applicable law.
